Terms of Service
of Dinamic5 Business
These terms set out your rights and obligations and ours when using the Dinamic5 Business platform. Please read carefully before getting started.

1. Definitions
"Company" — Dinamic5, operator of the Dinamic5 Business platform and the business.dinamic5.com site.
"Service" — the CRM platform with WhatsApp Business Cloud API integration from Meta, including the website, the application, the API, and related features.
"User" — any person or entity that registers for or uses the Service.
"Account" — the account created for the User upon registration.
"Meta" — Meta Platforms, Inc., owner of WhatsApp Business Cloud API.
2. Acceptance of Terms
By registering for or using the Service, the User confirms they have read, understood, and agreed to these terms in full. If you do not agree, please refrain from using the Service.
The Company may update these terms from time to time. Material changes will be posted on this site and registered users will be notified. Continued use after an update constitutes acceptance of the updated terms.
3. Description of Service
Dinamic5 Business provides a cloud-based CRM platform with official integration to Meta's WhatsApp Business Cloud API. The Service includes, among other things:
- Official integration with Meta's WhatsApp Business Cloud API
- Approved message template management
- Team shared inbox
- Bulk template sends in line with Meta's policies
- Lead, contact, and deal management
- Automations and workflows
- Quotes and digital signature
- Virtual PBX (optional)
- Integrations with external services (Facebook Lead Ads, Google, Webhooks, etc.)
- Mobile application

4. Registration & Account
Use of the Service requires registration with accurate and current information. The User is responsible for:
- Keeping login credentials confidential
- Any activity performed under their account
- Updating account details when they change
- Notifying the Company immediately upon suspected unauthorized use
The Company may refuse to open an account or close an existing one at its discretion, including for breach of these terms or Meta's policies.
5. Trial Period
Dinamic5 Business offers a free 14-day trial. During this period:
- No credit card is required at signup
- The User receives access to platform features at Basic plan quotas
- Actual use of WhatsApp Business Cloud API requires connecting a business number through Meta's Embedded Signup flow
- At the end of the trial, a paid plan must be selected to continue
- Data entered during the trial is retained after upgrade
6. Pricing & Payment
Listed prices exclude VAT as required by law. Payment is made in advance — monthly or annually, per the User's choice.
- The Company may update prices with 30 days' prior notice
- Plan upgrade takes effect immediately; the difference is prorated
- Plan downgrade takes effect at the start of the next billing cycle
- Non-payment may result in account suspension
- WhatsApp Business conversation fees: Meta charges separately for WhatsApp Business conversations (Conversation-Based Pricing) directly to the User through the User's WhatsApp Business Account in Meta Business Manager. These fees are not included in the Dinamic5 Business plan price and are not collected by the Company.
7. Permitted & Prohibited Use
7.1 Permitted use
The Service is intended for legitimate business use only — including customer management, sales, marketing, and business communication via WhatsApp Business Cloud API.
7.2 Prohibited use
The User undertakes not to:
- Use the Service for unlawful activity
- Send spam or marketing messages without recipient opt-in
- Violate the WhatsApp Business Policy and Commerce Policy
- Violate the Meta Business Tools Terms
- Send content that violates WhatsApp Business rules — harmful, misleading, threatening, or illegal content
- Copy, duplicate, or reverse-engineer the system
- Attempt to access systems or accounts of other users
- Transfer the account or access to a third party without authorization
- Use the Service in a way that harms performance for other users
Violation of Meta's policies may result in suspension or blocking of the User's Meta-verified WhatsApp Business number — the User's sole responsibility.
8. Compliance with Meta Policies
The User undertakes to comply with all Meta requirements when using WhatsApp Business Cloud API through the Service, including:
- Obtaining recipient opt-in before sending Marketing conversations
- Using message templates only after Meta approval
- Maintaining opt-in / opt-out records
- Providing clear opt-out for recipients
- Using templates per the approved category (Marketing / Utility / Authentication / Service)
- Maintaining number Quality Rating by sending relevant and lawful content
9. Intellectual Property
All rights in the Service — source code, design, logo, content, and documentation — belong to the Company and are protected by intellectual property law.
The User receives a limited, non-exclusive, non-transferable license to use the Service per these terms. This license does not confer any proprietary right in the Service.
Content entered by the User — messages, contacts, files — remains the User's property. The Company will not use User content for its own purposes, except as necessary to provide the Service.
WhatsApp, WhatsApp Business, and Meta are registered trademarks of Meta Platforms, Inc. Their use in the Service is made under Meta's authorization to the Company as an approved Tech Provider.
10. Service Availability & SLA
The Company aims for 99.9% availability and above. However, the Service may be unavailable from time to time due to:
- Scheduled maintenance — with at least 24 hours' prior notice
- Unforeseen technical issues
- Outages or changes on Meta's side (WhatsApp Business Cloud API)
- Force majeure
The Company is not liable for damages caused by temporary unavailability of the Service or of Meta's services.
11. Limitation of Liability
The Service is provided "AS IS". The Company does not warrant the Service will be free of errors or interruptions.
In no event will the Company's liability exceed the amount paid by the User in the past 12 months. The Company will not be liable for indirect, consequential, special, or punitive damages — including damages from suspension of a WhatsApp Business number by Meta.
12. Cancellation & Termination
The User may cancel the subscription at any time through the admin interface or by contacting support.
- Cancellation takes effect at the end of the current billing cycle
- After cancellation, data is retained for 30 days and then deleted
- Data export is available before cancellation
- Service removal does not affect the User's WhatsApp Business Account at Meta — manageable directly via Meta Business Manager

The Company may suspend or close an account with 7 days' prior notice for breach of terms, and immediately in serious cases.
13. Indemnification
The User undertakes to indemnify the Company against any damage, loss, expense, or claim arising from the User's breach of these terms — including breach of Meta policies — including reasonable attorney's fees.
14. Governing Law & Jurisdiction
These terms are governed by Israeli law only. Exclusive jurisdiction lies with the competent courts of the Tel Aviv district.
15. Severability
If any provision of these terms is found to be unlawful or unenforceable, the remaining provisions remain in full effect.
